Why Motor Insurance Is
Mandatory in India

The Motor Vehicles Act 1988, amended in 2019, makes third-party motor insurance compulsory for every vehicle on Indian roads. But the mandatory minimum is the floor — not the ceiling. Understanding the difference is what separates a real claim from a rejected one.

Third-Party Liability Cover

Legally required by the Motor Vehicles Act. Covers damage or injury caused to a third party — another person, vehicle, or property — in an accident that is your fault. Without this, you face criminal liability, heavy fines, and license suspension.

What Third-Party Does NOT Cover

Third-party insurance does not cover any damage to your own vehicle — no matter what happens. If your car is flooded, stolen, hit by another uninsured vehicle, or damaged in a fire, a third-party-only policy pays nothing for your own loss.

Comprehensive Cover — What You Really Need

A comprehensive policy covers both third-party liability AND damage to your own vehicle. It is the baseline from which you add protection layers through add-ons. Without comprehensive cover plus the right add-ons, most claims are only partially paid — or denied.

OWN Damage (OD) Cover

Own Damage cover protects your vehicle against accident damage, theft, fire, natural calamities (floods, earthquakes, cyclones), man-made damage (riots, strikes), and transit damage. This component can be purchased separately or as part of a comprehensive plan.

Buying Motor Insurance

Most motor insurance is sold at the dealership — by someone whose primary job is to sell cars, not protect you financially. These are the most common and costly mistakes buyers make without realising it.

Buying Whatever the Dealership Offers

Dealers typically push a single insurer — often the one that offers the best dealer commission, not the best coverage for you. The policy is pre-filled, handed to you at delivery, and you sign without reading a word.

⚠ The insurer chosen by the dealership may have a low claim settlement ratio or limited network garages in your city.

Choosing the Lowest Premium Without Reading Coverage

Comparing only the annual premium without checking what is covered, what is excluded, and what add-ons are included is the single biggest motor insurance mistake. The cheapest policy is almost always the weakest at claim time.

⚠ A ₹2,000 cheaper premium could mean ₹2–5 lakh less claim payout on a moderate accident.

Not Declaring Correct IDV

Insured Declared Value (IDV) is the market value of your car and the maximum amount the insurer will pay if the vehicle is written off or stolen. Many buyers lower IDV intentionally to save premium — and lose massively in total loss claims.

⚠ A ₹15L car insured at ₹10L IDV will only ever pay ₹10L at total loss — regardless of your actual loss.

Not Adding Zero Depreciation From Day One

Zero depreciation (zero-dep) must be purchased when the policy is first issued or at the first renewal. Many owners try to add it after an accident — at which point it is already too late. The depreciation deduction on parts can reduce your claim by 40–50%.

⚠ For a car less than 5 years old, not having zero-dep is one of the most expensive motor insurance mistakes possible.

Letting NCB Lapse Due to a Delay in Renewal

No Claim Bonus can reach 50% discount on your own damage premium after 5 consecutive claim-free years. If you forget to renew within 90 days of expiry, your entire accumulated NCB — sometimes worth ₹15,000+ in annual savings — is permanently lost.

⚠ Set a renewal reminder 30 days before expiry. Never let the policy lapse even for a single day without a break-in inspection.

Assuming a Comprehensive Policy Covers Floods

A standard comprehensive policy covers the vehicle body damage from floods — but does NOT cover engine damage from water ingestion (hydrostatic lock). Engine damage due to waterlogging requires a specific Engine Protection add-on and costs ₹3–10 lakhs to repair without it.

⚠ Engine protection is critical for vehicles in flood-prone cities — Chennai, Mumbai, Bengaluru, Hyderabad. Do not skip it.

Zero Depreciation

When your car is repaired after an accident, parts are replaced — but insurers deduct depreciation on those parts based on their age. Without zero-dep, you pay 20–50% of parts cost from your pocket. With zero-dep, the insurer pays the full replacement cost of parts.

Example: A bumper replacement costs ₹22,000. On a 3-year-old car, depreciation at 30% means insurer pays ₹15,400 and you pay ₹6,600. With zero-dep: insurer pays the full ₹22,000.
⚠ Must be added from day one. Available only for vehicles up to 5 years old in most policies. Do not delay.

Engine Protection

A standard policy covers the vehicle body — not the engine internals. Engine damage from waterlogging (hydrostatic lock), lubricant leakage, or oil seepage is explicitly excluded unless you have engine protection. Engine repairs cost ₹3–10 lakhs on modern cars.

Example: You drive through a flooded underpass in Chennai. Water enters the engine. Repair bill: ₹4.8 lakhs. Without engine protection — you pay every rupee. With it — fully covered.
⚠ Non-negotiable for any city with monsoon flooding. Chennai, Mumbai, Bengaluru, Hyderabad owners must have this.
Add-On 03

Return to Invoice (RTI)

In a total loss claim (vehicle stolen or written off), the insurer pays the IDV — which is always lower than what you paid for the car. RTI bridges this gap by paying the original invoice price, including road tax and registration charges, instead of the depreciated IDV.

Example: You bought a car for ₹12.5 lakhs. After 2 years, IDV is ₹9.8 lakhs. Car is stolen. Without RTI: you get ₹9.8L. With RTI: you get ₹12.5L. Difference: ₹2.7 lakhs in your pocket.
⚠ RTI is only available for vehicles up to 3 years old. After that, the IDV gap becomes permanent. Buy it early.
Add-On 04

Roadside Assistance (RSA)

24×7 emergency support when your vehicle breaks down anywhere — including flat tyre assistance, fuel delivery, battery jump-start, emergency towing, and on-site minor repairs. Critical for highway driving, night travel, and unfamiliar cities.

Example: Your tyre bursts at 11 PM on a national highway. RSA dispatches a technician within 30–45 minutes, changes the tyre, and gets you moving — at zero cost to you.
Add-On 05

Consumables Cover

Standard policies explicitly exclude consumables — nuts, bolts, engine oil, coolant, brake fluid, AC gas, grease, and similar items used during repair. These seem small but add up significantly on a large repair. Consumables cover reimburses these items in full.

Example: After a moderate accident, repair involves new brake fluid, engine oil top-up, AC recharge, and various fasteners — totalling ₹8,500 in consumables. Without this cover, you pay all of it separately.

NCB Protection

No Claim Bonus (NCB) builds up to 50% discount over 5 claim-free years — a significant annual saving. A single claim resets your NCB to zero. NCB Protection allows you to make a specified number of claims (usually 1–2 per year) without losing your accumulated NCB.

Example: You have 50% NCB saving ₹18,000 annually on premium. One claim resets it to 0%. At the next renewal, you pay ₹18,000 more. NCB protection would have preserved your discount for that one claim.
⚠ Most valuable for vehicles with 3+ years of claim-free history. The cost of NCB protection is a fraction of what you'd lose at renewal.

Passenger Cover

The mandatory personal accident cover under a motor policy covers only the owner-driver. Passengers are not covered. If a passenger is injured or dies in an accident while in your vehicle, the financial and legal liability can be significant without passenger cover in place.

Example: You carry three family members. An accident results in injury to all passengers. Your policy, without passenger cover, pays nothing for their medical treatment or compensation. With passenger cover, each passenger is insured for a specified sum.

Key Replacement Cover

Modern car keys are no longer simple metal pieces. Smart keys, proximity keys, and transponder keys cost ₹8,000–₹35,000 to replace, require dealer programming, and are typically not covered under standard policies. Key replacement cover reimburses the full cost of replacement and programming.

Example: You lose the smart key to your SUV. Replacement key + programming at the dealer: ₹22,000. Without key replacement cover — out of pocket entirely. With it — fully reimbursed.

Tyre Protection

Tyres are excluded from standard comprehensive policies. Damage from cuts, bursts, bulges, or kerb impact is your cost entirely. Tyre protection covers the cost of tyre repair or replacement due to accidental damage, including the mounting and balancing charges.

Example: A pothole burst costs you a tyre replacement on your SUV — ₹12,000 for one tyre. Standard policy pays zero. Tyre protection reimburses the full replacement including mounting.
⚠ Especially recommended for vehicles with run-flat or low-profile performance tyres which cost significantly more to replace.
Add-On 10

Electrical & Non-Electrical Accessories Cover

Aftermarket and factory-fitted accessories — dashcams, music systems, reverse cameras, fog lights, roof rails, bull bars, seat covers, and navigation systems — are not included in standard IDV calculations. If damaged or stolen, they are not covered without a specific accessory add-on declaring their value.

Example: Your car has a ₹55,000 infotainment upgrade and a ₹12,000 dashcam system. In a theft, standard policy pays nothing for these. Electrical accessories cover reimburses their declared value.
⚠ Declare accessory values accurately and keep receipts. Under-declaration means proportional payout; non-declaration means zero payout.

Hidden Gaps Most
Policy Holders Never Notice

Beyond add-ons, there are structural gaps in how standard policies are written. These are the clauses that only become visible when a claim is filed — and rejected.

Common Exclusion

Mechanical & Electrical Breakdown

Any damage caused by wear and tear, mechanical breakdown, or manufacturing defect is excluded. Motor insurance is not a maintenance plan — it only covers sudden, accidental events.

Claim Trap

Using the Vehicle for Commercial Purpose

If a privately-insured vehicle is used for commercial purposes — ride-sharing, delivery, or commercial transport — and an accident occurs, the insurer can reject the claim citing mis-use of the vehicle.

Legal Risk

Unlicensed or DUI Driver at Fault

If the vehicle is driven by someone without a valid license, or under the influence of alcohol or drugs at the time of the accident, the own damage claim is void. Third-party liability still applies — but you bear the legal consequences.

IDV Trap

Declared vs. Actual Market Value Mismatch

IDV is determined by depreciation schedules, not actual market value. For popular used cars with high resale value, the IDV may be significantly lower than what a buyer would actually pay — and that gap is yours to absorb at total loss.

Missed Deadline

Late Claim Intimation

Most policies require claim intimation within 24–48 hours of the incident. Delayed reporting — even by a day — gives insurers grounds to deny or reduce your claim, citing non-compliance with policy conditions.

Network Limitation

Repair at Non-Network Garage

Cashless claims are only available at insurer-empanelled garages. If you repair at a non-network garage — even an authorised dealer — you must pay upfront and apply for reimbursement, which is a slower and often disputed process.
